Handal Green Mobility Sdn. Bhd. 202301016604 (1510526-W) EVSE (Electric Vehicle Supply Equipment) Terms and Conditions of Use.

These Terms and Conditions of Use ("Agreement") govern the use of the Electric Vehicle Supply Equipment ("EVSE") provided by [Handal Green Mobility Sdn. Bhd. 202301016604 (1510526-W)] ("Provider") to the user ("User"). By using the EVSE, User agrees to be bound by this Agreement.

 

EVSE Use and Limitations

  1. The EVSE is provided solely for charging electric vehicles ("EVs"). User agrees to use the EVSE for its intended purpose and in accordance with applicable laws and regulations.
  2. User acknowledges that the availability and functionality of the EVSE may vary depending on factors such as location, power supply, and technical limitations. Provider does not guarantee uninterrupted or error-free operation of the EVSE.
  3. User is solely responsible for selecting the appropriate charging equipment and connector type compatible with their EV. Provider does not guarantee compatibility with all EV models.

User Obligations

  1. User agrees to follow all instructions, guidelines, and safety precautions provided by Provider and posted at the charging location.
  2. User shall not tamper with, modify, or misuse the EVSE. User shall not attempt to access or interfere with the EVSE's software, hardware, or any other components.
  3. User is responsible for the safe and proper use of the EVSE, including ensuring the EV is parked in a designated and safe area during charging.
  4. User agrees not to overload or cause damage to the EVSE or the electrical system by using adapters or extension cords unless approved by Provider.
  5. User shall not use the EVSE for any illegal, unauthorized, or prohibited purposes.

Fees and Payment

  1. User agrees to pay the fees associated with the use of the EVSE, as specified by Provider. Fees may include charging rates, connection fees, membership fees, or any other applicable charges.
  2. User authorizes Provider to charge the fees directly to the payment method provided by User or through a third-party payment processor. User is responsible for ensuring the payment information is accurate and up to date.
  3. User acknowledges that Provider may modify the fees and payment terms at any time. Notice of such changes will be provided to User through appropriate channels.

Liability and Indemnification

  1. User acknowledges that the use of the EVSE is at their own risk. Provider shall not be liable for any damages, injuries, or losses arising from the use of the EVSE, except where caused by Provider's gross negligence or willful misconduct.
  2. User agrees to indemnify, defend, and hold Provider harmless from and against any claims, losses, liabilities, damages, costs, or expenses arising out of User's use of the EVSE or violation of this Agreement.

Termination

  1. Provider reserves the right to terminate User's access to the EVSE at any time without prior notice, for any reason, including but not limited to violation of this Agreement or misuse of the EVSE.
  2. Upon termination, User shall immediately cease using the EVSE and return any access devices or materials provided by Provider.

General Provisions

  1. This Agreement constitutes the entire agreement between User and Provider regarding the use of the EVSE and supersedes any prior agreements or understandings.
  2. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
  3. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
